Hochul Seizes Control of Cornell Rape Probe After Local Officials Fumble

Governor Kathy Hochul is intervening in a high-profile sexual assault case at Cornell University, declaring that the victim was failed at every turn by local institutions. The case, involving allegations that a woman was drugged and raped by multiple fraternity members in 2024, was previously closed without charges.

Hochul, expressing a lack of confidence in District Attorney Matthew Van Houten, has handed the reins to Attorney General Letitia James. The Governor’s move follows revelations that local prosecutors failed to even interview the accuser.

While Van Houten defended his office by claiming they lacked sufficient evidence and were kept in the dark by university officials, Cornell maintains that it provided all relevant evidence, including incriminating Snapchat messages. The case has also reignited a debate over New York’s current legal standards regarding voluntary intoxication and consent.

Critics argue that existing state law creates a loophole that effectively grants immunity to perpetrators if a victim has voluntarily consumed substances.

Governor Hochul has vowed to push for legislative changes to ensure that voluntary intoxication cannot be used as a shield for sexual predators, a move that would align New York with roughly half of the other states.
